Terms of Service

1. Who we are

Direct Resell ("we", "us") operates the website direct-resell.com and the associated Discord services (together, the "Service"): an online marketplace where users can post and browse items for sale and "wanted" alerts across multiple resale markets, message each other, and optionally pay through our secure payment flow.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Our role

Direct Resell is an intermediation platform. We connect buyers and sellers; we are not a party to the sales contract concluded between them, we do not own, stock, ship or authenticate the items listed, and we act neither as buyer nor seller. Each sale is a contract directly between the buyer and the seller concerned.

3. Eligibility & accounts

• You must be at least 18 years old, or have verifiable consent from a legal guardian.
• You must provide accurate information and keep your credentials confidential. You are responsible for all activity on your account.
• One person may not operate multiple accounts to circumvent limits, bans or the reputation system.
• We may suspend or terminate accounts that violate these Terms, applicable law, or that present fraud risks.

4. Listings & prohibited items

You are solely responsible for the offers you post. Listings must be accurate (item, condition, size, price, photos) and you must be legally entitled to sell the item.

The following are strictly prohibited:

• Counterfeit or replica items, and any item infringing intellectual property rights;
• Stolen goods, or goods obtained by fraud (including carded/chargeback goods);
• Items whose sale is illegal or regulated in the buyer's or seller's jurisdiction (weapons, drugs, etc.); alcohol may only be traded between adults where legal;
• Digital goods or accounts whose transfer violates a third-party platform's terms, where such transfer is unlawful;
• Any listing used for money laundering, scams or price manipulation.

We may remove any listing at our discretion, with or without notice.

5. Payments, fees & escrow-style protection

Posting offers is free. When a purchase is made through the Service's payment flow:

• The buyer pays the item price plus a 2.5% buyer protection fee;
• The seller receives the item price minus a 2.5% seller fee;
• Payments are processed by Stripe (Stripe Payments Europe Ltd. and affiliates). Funds are held by Stripe, Direct Resell never holds your money itself, and are only released to the seller's wallet once the seller has marked the order as shipped and the buyer has confirmed reception;
• Sellers must complete Stripe's onboarding (identity and bank verification) before receiving payments. Payouts from the wallet to the seller's bank account are made via Stripe;
• Stripe's own terms apply to payment processing and payouts.

Users remain free to conclude transactions outside the Service's payment flow, at their own risk: such transactions benefit from no protection from us.

6. Orders, disputes & refunds

• Sellers must ship within a reasonable time after payment and mark the order as shipped.
• Buyers must confirm reception promptly once the item arrives. Confirming reception releases the funds and is final.
• If something goes wrong (item not received, not as described), either party can report a problem from the conversation. The funds are then frozen and Direct Resell reviews the case and decides, in good faith and at its reasonable discretion, to release the funds to the seller or refund the buyer (item price + buyer fee).
• Payment disputes initiated with card issuers (chargebacks) are handled through Stripe; abusive chargebacks may lead to account termination.
• Nothing in these Terms limits the mandatory legal rights of consumers in their country of residence, including statutory warranties against the seller.

7. Reputation & reviews

The Service displays reputation signals (positive feedback, warnings) collected on our Discord community and on the site. Reviews must be honest and based on a genuine transaction. We may remove content that is fraudulent, defamatory or unrelated to a real exchange.

8. Prohibited conduct

• Harassment, threats, hate speech or spam;
• Attempting to defraud, phish or impersonate other users or Direct Resell staff;
• Scraping, reverse engineering, or disrupting the Service;
• Circumventing fees, bans, or the dispute process.

9. Intellectual property

The Service, its logo, design and software are protected. You keep ownership of the content you post (photos, descriptions) and grant us a non-exclusive, worldwide licence to host and display it for operating and promoting the Service. Third-party brand names appear only to describe the items listed and remain the property of their owners.

10. Liability

The Service is provided "as is". To the maximum extent permitted by law, we do not guarantee the accuracy of listings, the conduct of users, or uninterrupted availability, and our total liability towards you for any claim related to the Service is limited to the fees you paid us in the 12 months preceding the claim. Nothing excludes liability that cannot be excluded by law (including gross negligence or wilful misconduct).

11. Changes & termination

We may update these Terms; material changes will be announced on the site or Discord and apply from their posting for future use of the Service. You can stop using the Service and delete your account at any time; pending orders remain governed by these Terms until completed.

12. Governing law

These Terms are governed by French law. Consumers also benefit from the mandatory protections of the law of their country of residence and may bring proceedings before their local courts. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
